We Represent Employees

We represent employees throughout New Jersey and the Tri-State Area in both the public and private sector. All employees are protected by state and federal employment laws. Indeed, New Jersey’s employment laws provide some of the strongest protections for employees in the United States. For example, New Jersey’s Law Against Discrimination protects employees from discrimination because of the immutable characteristics that make them who they are, such as race, religion, gender, sexual orientation, age, disability, national origin and ethnicity. This includes not just discrimination in terms of hiring, firing or pay, but also the right to be free from harassment because of any of these protected qualities. New Jersey employment law also protects employees from retaliation for “blowing the whistle” and disclosing, objecting to or refusing to participate in any of their employer’s activities which they reasonably believe is illegal. It is also illegal to retaliate against employees for filing a workers compensation claim. Employees also have wage and hour protections under federal and New Jersey employment law which protects their right to receive the pay they are entitled to, when they are entitled to receive it, including overtime. We Represent Employers

Our employment law attorneys also represent private sector employers. We represent employers in the full range of employment law issues. We counsel employers on their rights, and how to ensure that they are running a productive workplace which is compliant with all its legal requirements and free from discrimination, harassment and retaliation. We also represent employers in negotiations with their employees. We help our clients ensure that they are running a place of business where there would no reason for them to be sued. We Represent Government Employees

Public sector employees have all the legal protections of private sector employees, but also have additional protections which apply only to them. For example, state employees and many local workers have civil service protection from arbitrary discipline, unjust firing, and unfair hiring practices. Teachers and school administrators have tenure protections under Title 18a. Law enforcement officers and firefighters have additional employment protections under Title 40A. Additionally, because public sector employees are employed by governmental entities, the United States and New Jersey Constitutions also protect government employees. For instance, government employees have due process and First Amendment speech rights which private sector employees do not enjoy. We represent government employees in the full range of employment law issues, from federal and Superior Court litigation, to civil service appeals, appointing authority hearings, and appeals of tenure charges.
